Forecast by the Federal Republic of Germany on the use of flexible cooperation mechanisms for achieving national targets pursuant to Article 4 (3) of Directive 2009/28/EC
According to Article 4 (3) of Directive 2009/28/EC on the promotion of the use of energy from renewable sources, all member states must publish a forecast document by 31 December 2009 on the use of flexible cooperation mechanisms and notify this to the European Commission.
With the aid of flexible cooperation mechanisms, which are described in more detail in the Directive, a member state can achieve its national target in cooperation with other member states that have excess amounts of energy from renewable sources.
The forecast document serves as an initial orientation regarding where and on what scale there is potential within the EU for use of these mechanisms.
The member states' forecast documents will be published on the European Commission's transparency platform.
On the basis of existing scientific studies, the German government predicts in its forecast document that Germany will achieve a renewables' share of 18.7% in gross final energy consumption in 2020. This means Germany expects to slightly exceed the 18% target set in the Directive.
According to this forecast, Germany is not dependent on the flexible mechanisms to achieve its target. In fact, Germany could offer the predicted excess amount of energy from renewable sources for transfer to other member states via the various cooperation mechanisms.
How exactly such a transfer through the use of cooperation mechanisms could be carried out needs to be further reviewed, especially from a legal perspective. Each specific case where excess amounts may be transferred must be evaluated and decided on individually.
Member states must update their forecast documents on the use of flexible cooperation mechanisms in the national renewable energy action plans required by the Directive by 30 June 2010 and in the progress reports to be produced every two years from 2011.
